As long as they don't launch wmds or occupy space territory (moon, asteroid, or other natural body), they aren't violating the space weapons ban treaty.

There is a treaty that forbids purposely making space debris or destroying foreign satellites but the article indicates that the Japanese intend to prevent those actions, not cause them.
